Waiter Claims for Back Injury at Slieve Russell Hotel

A waiter, who allegedly damaged his back due to lifting trays at the Slieve Russell Hotel, has been providing evidence at the High Court in support of his waiter claims for back injury compensation.

Robert Miloch, from Ballyconnell, County Cavan, brought the actions against the hotel and its parent company after sustaining a back injury in April 2010. The court was told that as Mr Miloch was squatting down to place trays on a trolley he heard a clicking noise in his back and started to experience a severe pain. He was later told to go home and see his doctor.

Mr Miloch said in court that an MRI scan taken at the time showed two discs putting pressure on a nerve and, as a result, he was advised by his doctor not to return to work. The lumbar back pain Mr Miloch suffers from has not improved despite physiotherapy and prevents him, the court heard, from picking up his nine-month-old child.

 Mr Justice Sean Ryan heard that the Slieve Russell Hotel and Quinn Hotels Limited – against who the waiter claims for back injury compensation were also made – denied liability for Mr Miloch´s injury and alleged that Mr Miloch´s doctor had reported “paradoxical findings” in relation to Mr Miloch´s injury as well as claiming that the extent of the injury could have been exacerbated by a rear-end accident Mr Miloch was involved in later in 2010.

The case at the High Court continues.
